Do I need a California Business Seller's Permit?
SWAP vending is allowed only if…
1.) The seller possesses a seller’s permit.
2.) Or the seller is exempt from needing one.
A permit is mandatory when selling new or used items purchased for resale or if you engage in regular sales.
However, you don’t need a permit for ‘occasional’ sales (up to twice in 12 months) of personal items accumulated for your use (e.g., clearing out your garage).”
How do I get a California Business Seller's Permit?
You are welcome to reach out to the West Covina branch of the California Department of Tax and Fee Administration by calling (626) 480-7200 or visiting their official website at www.cdtfa.ca.gov.
What if I'm just clearing out my garage?
If you engage in occasional selling, you are exempt from holding a seller’s permit. Occasional sellers typically include individuals who sell their own used items from their garage, provided they make sales no more than twice within 12 months. Instead of obtaining a permit, you’ll need to complete the State of California’s Swap Meet Certification form (CDTFA-410-D) to certify your status as an occasional seller.
Step #1
Download the 1-page form, www.cdtfa.ca.gov/formspubs/cdtfa410d.pdf.
Step #2
Bring a copy of this completed (CDTFA-410-D) form to the TRAIL BASH SWAP and give it to your event ticket scanner upon entry.
